January 6 Committee Subpoenas Trump White House Counsel Pat Cipollone for Testimony

The House committee looking into the Capitol riot sent a subpoena to Trump White House counsel Pat Cipollone after hearing explosive testimony from a former White House aide who said Cipollone had raised concerns about Donald Trump’s plans for January 6, 2021.

The committee’s chair, Rep. Bennie Thompson, D-Miss., and vice-chair, Rep. Liz Cheney, R-Wyo., said in a statement, “The Select Committee’s investigation has found evidence that Mr. Cipollone repeatedly raised legal and other concerns about President Trump’s activities on January 6th and in the days before.”

The two lawmakers talked about Cipollone’s “earlier informal engagement with our investigation” in April, but they insisted that the committee needed to hear from him “on the record.”

“Any concerns Mr. Cipollone has about the institutional prerogatives of the office he previously held are clearly outweighed by the need for his testimony,” the statement said.

Several news agencies have asked Cipollone for his thoughts.

A lawyer who was familiar with Cipollone’s thinking said that the subpoena was needed to look at transcribed testimony before the committee and that Cipollone would now look at privilege issues as needed.

In a letter to Cipollone, Thompson said that the committee had evidence about which he was “the best person to testify.”

“Unfortunately, however, you have declined to cooperate with us further, including by providing on-the-record testimony,” Thompson wrote. “We are left with no choice but to issue you this subpoena.”

The subpoena was issued just a few hours after Cheney asked Cipollone to testify even more. On Jan. 6, former White House staffer Cassidy Hutchinson gave damning testimony about the actions of a number of her colleagues.

Cheney said that Hutchinson’s comments about Cipollone’s worries about Trump’s plans for January 6 showed that it was important to hear directly from him.

Hutchinson has said that Cipollone was very worried about the possibility of stopping the count of electoral votes on January 6. He told her, “It would look like we were inciting or encouraging a riot.”

Hutchinson said in a video played at Tuesday’s hearing that she heard Cipollone say over and over again that they “need to do something more” after hearing that Trump supporters were chanting “Hang Mike Pence” at the Capitol.

Hutchinson also talked about a fight between Cipollone and White House chief of staff Mark Meadows on the afternoon of January 6. He said that Cipollone said that if nothing was done to stop the mob, “people are going to die and the blood is going to be on your effing hands,” meaning that the White House staffer would be responsible for the deaths.
